HIGHLAND SECURITY SERVICES - TERMS AND CONDITIONS OF SERVICE
NATURE OF SERVICE
PATROL, RESPONSE, GUARD, ALARM MONITORING SERVICE
COMPETITION AND CONSUMER ACT 2010
i) the supplying of the services again; or
ii) the payment of the cost of having the services supplied again.
INSTALLATION OF EQUIPMENT
TERMINATION OF SERVICES
a) Either party may terminate the agreement by giving the other not less than (1) one month written notice. Any notice pursuant to this clause must be given by the client and not any person acting or purporting to act on behalf of the client.
b) If this is within the 12 month minimum monitoring period in our promotions then the remainder of the contract term needs to be paid in full.
c) Highland Security may terminate this agreement immediately if the client is in breach of any of these conditions or if the client commits any act of bankruptcy, makes any arrangement or composition with its creditors, has a receiver or manager appointed over any part of its undertaking or assets, has any petition presented for its winding up or goes into liquidation on a voluntary or compulsory basis.
NON-ASSIGNABILITY
a) The client shall not assign its rights or transfer its obligations here under without prior written consent of Highland Security Services.
PERSONAL GUARANTEE
The directors (hereafter “guarantors”) of any corporate entity contracting Highland for its services, jointly and severally, unconditionally guarantee the due and punctual observance by the corporate entity of all its liabilities and obligations, the guarantor(s) shall indemnify Highland immediately against all losses, damages, costs and expenses which may be incurred, suffered or sustained by Highland by reason of the default. The guarantor(s) shall pay to Highland immediately upon demand the amount of the losses, damages, costs and expenses, which Highland may incur or sustain as a result of the default. This guarantee is a continuing guarantee And irrevocable and not transferable until the corporate entity has discharged all its obligations under this agreement.

All calls to and from Highland Security are recorded for quality and training purposes.
PAYMENT OF ACCOUNTS
a) Highland accounts are as stated on the invoice unless otherwise agreed in writing with Highland.
b) Failure to pay a Highland account can result in a restriction, cancellation of services without further notice from Highland and or engagement of Debt Collectors of which all associated costs will be charged to the client.
PAYMENT OPTIONS
1) Direct Deposit -Payment can be made via direct deposit (Electronic Funds Transfer) to our ANZ Account.
Please ensure you use your invoice as a payment reference.

NATURE OF SERVICE
- Highland Security Services Pty Ltd (Highland Security) is not an insurer & any insurance against fire, theft, damage, loss, death, injury or any other cause to the premises, property or persons must be obtained by the client at its own cost.
- The charges payable by the client are based solely on the value of the services & are unrelated to the value of the client’s premises or property or the property of others located at the clients premises.
- The service is of a deterrent nature.
PATROL, RESPONSE, GUARD, ALARM MONITORING SERVICE
- The client acknowledges that security services are a shared service with the clients of Highland Security and whilst Highland Security at all times shall use its best endeavours to provide the stated services, interruptions or delays (or both) caused by break-ins at any other clients premises & other emergencies including fire, flood, accident, breakdown, police or emergency service activities may prevent the stated services being carried out during each service period.
- Highland Security shall not be liable to the client for any loss or damage caused by any reason beyond the control of Highland Security including but not limited to mechanical break-down, storm, earthquakes, strikes, lock-outs, labour disputes of whatever type, act of god, war (whether declared or not) act (administrative or legislative) of any government, riot or civil commotion, fire, explosion, burglary or act of omission of the client, its servants or agents.
- Highland Security shall not be liable to the client for any consequential damage.
- Highland Security shall not be liable to the client for any loss or damage suffered by the client including loss or damage resulting from the negligence of Highland Security or any of its servants, agents or employees.
COMPETITION AND CONSUMER ACT 2010
- These conditions shall be read subject to the Competition and Consumer Act 2010 (Commonwealth) and to any implied terms, conditions or warranties imposed by that Act or any other Commonwealth, State or Territory legislation insofar as that legislation may be applicable and prevents either expressively impliedly the exclusion or modification of any such term, condition or warranty.
- In cases where Part V Division 2 of the Competition and Consumer Act 2010 (or equivalent part of any State or Territory legislation) applies to the supply of goods or services other than those ordinarily acquired for personal, domestic or household use or consumption, Highland Security liability to the client shall be limited as Highland Security determines:
In the case of goods to any one of the following:- the replacement of the goods or the supply of equivalent goods;
- or the repair of goods; or
- the payment of the cost of replacing the goods or of acquiring equivalent goods;
- the payment of the cost of having the goods repaired.
i) the supplying of the services again; or
ii) the payment of the cost of having the services supplied again.
INSTALLATION OF EQUIPMENT
- Equipment installed by Highland Security will remain the property of Highland Security until paid in full. If the client goes into bankruptcy, voluntary or involuntary liquidation/ if the invoice remains unpaid after payment terms expire we reserve the right to attend to remove said equipment.
- Additional security services &/or equipment & upgrades are available upon request & are not limited to our quotation
